This Terms of Service Agreement, along with our Privacy Policy, Acceptable Use Policy, Service Level Agreement, and Cookies Policy, governs your use of our website and services (“Services”).
Acceptance
By using our Services or clicking “I have read and accepted Terms of Service,” you agree to these Terms of Service. If using Services on behalf of an organization, you confirm your authority to bind that organization.
Privacy Policy
By using our website or services, you agree that we may use your personal information per our Privacy Policy.
Arbitration Agreement
All disputes between you and AplusHosting will be resolved by binding arbitration. You waive the right to go to court to assert or defend your rights. Details are in Section 15.
Modification of Terms
AplusHosting reserves the right to modify these Terms of Service at any time without prior notice. Continued use of the Services constitutes acceptance of such modifications.
Eligibility and Account
Users must be 18 years or older. We may refuse services to anyone and terminate accounts for violations. You are responsible for all activities on your account and must provide accurate, complete information. Notify us immediately of any unauthorized use of your account.
Content and Conduct
You are responsible for all content you post. Content must comply with laws and our policies. Prohibited content includes, but is not limited to, pornography, illegal activities, and hate speech. You agree not to use the Services for unlawful or harmful activities.
Payment and Billing
AplusHosting accepts Bitcoin, major credit cards, debit cards, and PayPal. Payments are processed by third-party processors. You must provide accurate billing information and keep it updated. Services renew automatically unless canceled.
Refund Policy
Certain services are non-refundable. Refunds, when applicable, will be made using the original payment method. Details on non-refundable services and conditions are provided.
Limitation of Liability
AplusHosting is not liable for any indirect, incidental, or consequential damages. Our total liability will not exceed the fees paid for Services in the past month.
Indemnification
You agree to defend, indemnify, and hold harmless AplusHosting from all liabilities, claims, and expenses arising from your use or misuse of the Services.
Termination
We may terminate your access to Services at any time for violations of these Terms or other reasons. Upon termination, all rights granted to you will cease, and you must stop using the Services.
Dispute Resolution
Before initiating arbitration, parties will attempt to resolve disputes through good faith negotiation. Arbitration will be conducted per the rules of the American Arbitration Association.
Miscellaneous
This Agreement constitutes the entire agreement between parties. If any provision is deemed unenforceable, the remaining provisions remain in effect. Notices should be sent to legal @ aplushosting.asia.
Email Services & Enhanced Verification
Use of AplusHosting services for email-related activities, including but not limited to SMTP access, mail server operation, bulk messaging, or any form of outbound email delivery, is subject to enhanced review and verification.
AplusHosting reserves the right to require additional information from the customer at any time, including but not limited to:
• Detailed description of intended use
• Domain ownership and DNS configuration verification
• Identification and/or business verification (KYC)
• Proof of recipient consent for email communications
Access to email-related functionality, including but not limited to outbound SMTP ports (25, 465, 587) and reverse DNS (rDNS) configuration, is restricted by default and will only be granted upon successful review.
AplusHosting reserves the sole and absolute discretion to:
• Approve or deny any request related to email functionality
• Request additional documentation or verification at any stage
• Revoke previously granted access without prior notice
• Apply limitations or restrictions based on risk assessment
Requests may be declined without justification, particularly in cases where the intended use, risk profile, or provided information does not meet internal compliance or anti-abuse standards.
Any use of the service for:
• Unsolicited email (spam)
• Bulk messaging without verifiable opt-in
• Email bombing or harassment
• Activities resulting in blacklist listings or abuse reports
will result in immediate suspension or termination of the service, without refund.
The customer is solely responsible for ensuring that all email activity complies with applicable laws, regulations, and AplusHosting’s Acceptable Use Policy.
